Information obligation

according to Art. 13 and Art. 14 DSGVO

The protection of your data and the transparency of their processing is very important to us. We therefore comply with our obligation to provide information on the circumstances of processing in accordance with Art. 13 and Art. 14 of the Basic Data Protection Ordinance (DSGVO).

The processing of your personal data gives you the following rights:

  4. Right to restrict data (see Art. 18 DSGVO)

Right of withdrawal: If the processing referred in Art. 6 DSGVO paragraph 1 letter a or Art. DSGVO 9 paragraph 2 letter a, you have the right to revoke your consent at any time without prejudice to the legality of the data collected on the basis of the consent until revocation.

Responsible body is the natural or legal person, alone or together with others, who decides on the purposes and means of processing personal data (e.g. names, e-mail addresses, etc.).

1.1 Communication by e-mail

To get in touch with you, we will write you an e-mail, if necessary, with further information, for processing your inquiry, your order or in the context of our general business relationship. For this purpose, your e-mail address, the e-mail content and the history of communication are recorded. The processing of the data is based on the fulfilment of the contract pursuant to Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures (customer relationship, contracts with business partners, authorities, employees).
The data will only be passed on if this has been agreed with you or is necessary for the current business transaction.
Your data will be stored on our systems within the scope of the legal obligation to store them.

1.2 Head office, visitor management

Distribution of incoming mail to the respective departments, persons. Personal letters are delivered unopened. Answering the central calls and forwarding. Reception of visitors and entry of the visitor in the visitor sheet, in order to have an overview of which external persons are on the site.
For this purpose we collect the following data from you: Name of employee, business partner Name, attendance times of visitor, signature of visitor.
The data collection is based on a legal requirement according to art. 6 par. 1 lit. c DSGVO. The processing is necessary for the fulfilment of a legal obligation to which the person responsible is subject (occupational safety, occupational safety, postal secrecy); in addition, the person responsible has a justified interest in allowing only authorised persons into the company premises.
The data will only be passed on if this has been agreed with you or is necessary for the current business transaction.
Your data will be stored on our systems within the scope of the legal obligation to store them.

1.3 Print and copy jobs (external service provider)

To ensure the availability of our printers and copiers, we use an external support and leasing service for printers and copiers.
The service technicians may have access to print jobs, information about people on print jobs and the customer for printing.
The processing of the data is based on contract fulfilment in accordance with Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures (support contract).
The data will not be passed on. We have concluded a corresponding data protection compliance agreement with the service provider.
Your personal data will be stored in the device for a period of time during processing.

1.4 Guests WLAN

For our guests in our plants, we offer Internet access as a service. You will receive a personal access code for a defined period of time. You must confirm the usage guidelines before use. We record your surname, first name, company name of the visitor, Internet protocol data, IP address, connection time, duration of access.
The processing is based on your voluntary consent pursuant to Art. 6 para. 1 lit. a DSGVO by agreeing to the terms of use before using the WLAN. You can revoke your consent at any time. All you need to do is send us an informal e-mail. The legality of the data processing processes already carried out remains unaffected by the revocation. The data will not be passed on. We reserve the right to take further measures based on the stored data.
The data is stored for one year.

1.5 Order entry and processing

In order to process your order or inquiry, we collect personal data from contact persons (name, e-mail address, telephone number, responsibility in your company).
Processing is based on a contract or pre-contractual measure pursuant to Art. 6 (1) (b) DSGVO.
This information is forwarded internally to the necessary departments and, if necessary, to external bodies subject to confidentiality. The data is stored within the framework of the legal storage obligations.

1.6 Financial Accounting

For processing financial accounting in various IT systems: SAP, Office, and online banking tools and for electronic invoice processing (verification, approval), we have mapped a process in the company. In the process, personal data may be processed by contact persons or on billing information (name, e-mail address, telephone number). The processing is based on a legal requirement according to Art. 6 para. 1 lit. c DSGVO. Processing is necessary to fulfil a legal obligation to which the controller is subject (principles of proper accounting). A forwarding does not take place. The data is stored within the framework of the legal storage obligations.

1.7 Data protection management

You can contact the external data protection officer at any time by e-mail to datenschutz@linhardt.com or by telephone on 09921 9064711.
Your name, the reason for the request, the facts of the case and any data of the person concerned stored in the system will be collected and stored.
The processing of the data is based on the fulfilment of the contract pursuant to Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures (service contract, employment contract).
The information will only be passed on with your consent. Your personal data will be stored for as long as necessary for the purpose. Legal storage obligations remain unaffected.

1.8 Applications

Your applications will be sent to the Human Resources Department (by post or e-mail). The latter forwards the applications to the relevant specialist departments. After hiring, the employee’s data is transferred to the HR department in Viechtach in order to enter your data in SAP and create you as a user in the IT systems. Applications will be sent back to the first sheet. If applications are withheld, you must actively agree that we may retain your documents. We store your application documents (CV, cover letter, certificates,…). Your data will only be forwarded to the internal departments required for the application process.
The processing is based on a pre-contractual measure to the employment contract according to Art. 6 (1) lit. b DSGVO.

2 Video surveillance

 

2.1 Video surveillance system Viechtach

The data is recorded by video cameras at the gates to ensure that only authorised trucks and cars enter the premises. Trucks and cars are monitored, but in individual cases people can also be seen during transmission.
The processing of the data is based on a business purpose according to art. 6 par. 1 lit. f DSGVO. The responsible person has a legitimate interest to avoid or to recognize the access to the company premises to rules and crimes.
Video surveillance can be viewed on the monitors at the doorman’s office. A storage and passing on of the data does not take place.

 

2.2 Video surveillance system Pausa

The data is recorded by video cameras at the gates to ensure that only authorised trucks and cars enter the premises. Trucks and cars are monitored, but in individual cases people can also be seen during transmission. Furthermore, the information serves to prevent criminal offences and to collect evidence in the event of vandalism, burglary or other criminal offences.
The processing of the data is based on a business purpose according to art. 6 par. 1 lit. f DSGVO. The responsible person has a legitimate interest to avoid or to recognize the access to the company premises to rules and crimes.
Video surveillance can be viewed by IT staff and, if required, by management. Your personal data will be stored during the processing for a period of 4 days / 20 days (in case of movement).
The data will not be passed on.
